Welcome to airyfairycakeco.com (the ‘site’ or ‘website’). By using this site you are agreeing to follow and abide by our terms and conditions and privacy policy. Throughout these terms, we will refer to ourselves as ‘AiryFairy’, ‘us’, ‘we’ or ‘our’ – this means ‘AiryFairy’ Limited. We may revise the Terms and Conditions and Privacy Policy at any time without notice to you. Please read out terms and conditions carefully.
1 Prices & Descriptions
Our prices guide is stated on the website,but we reserve the right at any time to revise the price of goods without notice. Weights,sizes, dimensions and portions are approximate. Whilse we take great care to ensure that all prices are correct, no responsibilty will be accepted for errors and omissions. All Airyfairy cakes are baked with butter ,sugar , flour (wheat) , eggs. Gluten free,dairy free , vegan options are avalible on requests. However we cannot guarntee our cakes dont contain trace of nuts as we work in an enviroment with nuts in our kitchen.
2. Availability
All orders are subject to availabilty. Our cakes are freshly baked to order so require at least 24 hours notice however please give us as much notice as possible to avoid dissapointment.
3. Colours
The colours of our cakes are matched closely but we can not guarantee they will be identical. The websites photos are a guide only and the final product may vary slightly. Where a cusotmer requests a specific colour , will we try our best to match as close as possible but please be aware that our sugarpaste(fondant) and buttercream do vary in colour are we cannot guarantee an exact match.
4. Minimum orders
Our 'teeny tiny' cupcakes require a minimum order of 48 =£32. Minimum cupcake order is 12= £24. Delivery charges additional. Please email info@airyfairycakeco.com to ask us about minimum orders for any other items.
5.Payment terms
We accept payment by paypal or Visa Debit/Credit cards, bank transfer, For all orders we will require full payment in advance before delivery. Amex is not accepted unfortunately.
6.Delivery charges
We offer delivery across Manchester and Cheshire areas. However will deliver out of these areas for bigger orders. There is a charge for delivery which starts from £5 +.
7. Delivery
We will deliver the goods to the address you specify. It is important that this address is accurate. Please be precise about where you would like the goods left if the intended recipient is out when we deliver. If no instructions are given we will leave with a neighbour and post card with details. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence).
We recommend that in cases where the person placing the order is not the recipient of the delivery they advise the recipient to expect a delivery.
A option for AM OR PM delivery will be given with a window time frame but we can not guarntee a set time for delivery.
ou will become the owner of the goods you have ordered when they have been delivered to you or your chosen recipient. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
8. Cake stand hire
Our cake stand hire cost £10 per event. We will also require a £50 deposit refunded once stand is collected or dropped back off as a guarantee against loss or damage to the stands. You agree that damaged or missing pieces will be charged to you at their replacement cost, including any postage/handling charged to us by the supplier. To help prevent damage, we agree that you may return the stands to us unwashed.
Hire of cake stands is at our discretion. The stands remain our property, and you agree to return the stands to us in complete and without damage by the agreed date.
9. Weddings
Our samples or consulations cost £10 which is refunded if order goes ahead. A 50% deposit will be required upon booking. Deposits are non-refundable. The final balance is due at the latest 30 days prior to your wedding. Airyfairy accepts no liability for cakes that are damaged after they have been delivered to the agreed location. Once your cake is set up at the venue a photo will be taken as proof and then all responsibility will be passed on to the venue. Airyfairy will take no responsibilty for cakes that are damaged during display at your wedding.
10. Contract
Full payment is required when you order. Your payment represents an offer to purchase. Our acceptance of your order completes the contract between us.
11. Risk and ownership
Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.
12. Cancellation rights
Under the Distance Selling Regulations you do not have the legal right to cancel orders of made-to-order items, which includes all our cakes and cupcakes. However, if we have not yet ordered ingredients for them, we may cancel your order at our discretion.
13. Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent us by email to info@airyfairycakeco.com
14.Changes to legal notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
15. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
16. Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.
17. Third party rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
18. Jurisdiction
These terms and conditions will be governed by the laws of England and Wales and by using the Website you agree to submit to the exclusive of the courts of England and Wales.
19. Intellectual property
All of the content on the site including pictures, graphic design and text are subject to copyright and other intellectual property rights held by ‘Hey Little Cupcake!’ Ltd. The entire content of the site is copyrighted under applicable copyright laws. The use of our site heylittlecupcake.co.uk and it’s content is intended for the personal and non- commercial use by the users of our site.
20. Use of the site
You may download, view, copy and print documents and graphics incorporated in these documents (the “Documents”) from the Site subject to the following: (a) the Documents may be used solely for personal, informational, non-commercial purposes; and (b) the Documents may not be modified or altered in any way.
